SERVICE AGREEMENT

Service Agreement: Everything You Need to Know

Introduction

When it comes to renting a dumpster for waste disposal, it's important to have a clear understanding of the service agreement. The service agreement legally binds the customer and the dumpster rental company to a set of conditions and responsibilities. In this article, we will delve into the key aspects of a service agreement, outlining the obligations of both parties involved. Whether you're a homeowner or a contractor, this information will help ensure a smooth and hassle-free waste disposal experience.

Agreement Details

The service agreement between the customer and Dallas Junk Bin Inc. is governed by the laws of the Province of Ontario. It is essential to familiarize yourself with the conditions listed in the agreement before placing a dumpster rental order. Dallas Junk Bin Inc. agrees to provide customers with non-hazardous solid waste collection, transportation, disposal, and recycling services. Let's now explore some of the crucial points to keep in mind when entering into a service agreement.

Providing Notice for Service

To ensure efficient dumpster delivery, exchange, termination, or relocation, the customer must provide Dallas Junk Bin Inc. with at least one business day (24 hours) notice. It's important to note that service requests made after 12 noon may not guarantee service for the next business day. Occasionally, external factors such as inclement weather, equipment failures, landfill delays, or traffic conditions may cause service delays.

Blocked Dumpster

In the event that Dallas Junk Bin Inc. attempts to deliver or pick up a dumpster and encounters a blocked dumpster or a locked gate, the customer will be subject to a $150 No Service fee. It is the responsibility of the customer to ensure unrestricted access to the dumpster and avoid any obstructions that may hinder its delivery or pickup.

Prohibited Waste

Customers are strictly prohibited from disposing of hazardous and toxic waste in the dumpsters. This includes waste such as industrial waste, asbestos-containing materials, septic tanks, paint, cleaning solutions, biomedical waste, pesticides, solvents, appliances with Freon, aerosol cans, ballasts with PCBs, devices containing mercury, fluorescent bulbs, telephone poles, railroad ties, and household garbage (including food waste). Violation of this prohibition will result in the customer being held responsible for the disposal and any associated costs.

Disposal Fees

Should hazardous or toxic waste be found in the dumpster, Dallas Junk Bin Inc. has the right to charge the customer a disposal fee. The customer is required to make full payment before or at the time of bin delivery. Additional disposal fees may be charged for the proper handling and disposal of hazardous waste. It is crucial to comply with the waste disposal regulations to avoid any penalties or additional fees.

Equipment Ownership and Responsibility

All equipment provided by Dallas Junk Bin Inc. remains the property of the company. However, the customer has responsibility and liability for the equipment and its contents while it is in their possession. The equipment should only be used for its intended purpose, and the customer should not attempt to move or alter it. The customer is obliged to provide unobstructed access to the equipment on the scheduled pickup day. It is important to note that Dallas Junk Bin Inc. is not responsible for any damage caused to the customer's property during the provision of services.

Overfilled and Overweight Dumpsters

Customers must ensure that the dumpsters are not overfilled beyond the designated "Max Load" indicator. Overfilling a dumpster can lead to debris falling out and potentially causing damage to other vehicles. Moreover, it is illegal to transport an overfilled dumpster. Dallas Junk Bin Inc. reserves the right to refuse pickup of an overfilled dumpster. If the customer disregards this requirement, they will be responsible for removing the excess debris and will be subject to a $150 No Service fee.

Dallas Junk Bin Inc. also reserves the right to refuse pickup of dumpsters that exceed an estimated weight of 4,000 kgs (4.4 tons). Should the dumpster be overweight, the customer is responsible for removing debris until it falls below the weight limit. In such cases, a $150 No Service fee will be charged.

Rental Duration and Fees

Each dumpster rental includes a 7-day period, as specified in the confirmation or invoice provided to the customer. If the dumpster is not emptied and returned or removed by the customer's request within this period, a daily rental fee of $20.00 will apply for each additional day. If the dumpster is emptied and returned, it is considered a new rental and includes another 7-day period.

Indemnity and Liability

The customer agrees to indemnify, defend, and save Dallas Junk Bin Inc. harmless from any and all liability arising from bodily injuries, property damage, or violation of the law resulting from the customer's breach of the agreement or negligent conduct. Neither party will be liable to the other for consequential, incidental, or punitive damages related to the performance or non-performance of the agreement.

Conclusion

Understanding the terms and conditions outlined in the service agreement is essential when renting a dumpster. By adhering to these guidelines, both the customer and Dallas Junk Bin Inc. can ensure a smooth and problem-free waste disposal process. Remember to provide advance notice for service, avoid prohibited waste, and adhere to the guidelines regarding dumpster filling and weight limits. By doing so, you can enjoy a hassle-free dumpster rental experience while responsibly disposing of your waste.
